Likewise, the User undertakes, within the framework of contractual good faith, to quickly and effectively report any infringement or well-founded fear of infringement by third parties of the Application, which could affect the legitimate interests of the Owner.

The User will retain all industrial and/or intellectual property rights that he or she owns over the information and content that may be stored through the Application within the framework of its use under the License.

Limitation of liability

The Owner declines any responsibility in the event of interruptions or malfunctions of the Services or content offered on the Internet, whatever the cause. Likewise, the Owner is not responsible for network outages, business losses as a result of such outages, temporary suspensions of electricity or any other type of indirect damage that may be caused to you by causes beyond the control of the Owner.

The Owner will not have any responsibility for damages of any nature that may be due to fraud in the utility that the Users and/or the user may have attributed to the application and the reliability of the service and content accessible through the application.

The total liability of the Owner, whatever the cause, may not exceed the total amount billed to the user for the license, and under no circumstances may the Owner incur any liability for loss of profits, loss of profits, consequential damage or any other direct or indirect damage.

The user is solely responsible for the custody and secrecy of the usernames and passwords and number of licenses of the Application.

The Owner is not responsible, in any case, for damages of any nature that may arise from access or use of the application by the user or its users contrary to the provisions of this Legal Notice and/or non-compliance or defective compliance with the obligations of the user and/or incorrect use of the application that negatively affects its operation.

The owner is not responsible for: i) Third-party software and ii) the nature and typology of the information and content stored by the user.

Neither Party will be liable to the other or a third party for indirect, special, consequential or incidental losses, for direct or indirect damages and resulting from: a) loss of income, b) loss of opportunities, c) loss of profits; d) recovery costs, even if the Party has been notified of such damages, except for fraudulent, delinquent conduct or failure to comply with the provisions of this legal notice by any of the Parties.

The Owner makes the Application available to the user without any implied or presumed warranties, including fitness for a particular purpose, absence of defects or errors, compatibility with a specific system, or accuracy of the information contained therein, except as expressly stated in this Legal Notice. The user relies on the Application and its results exclusively at their own risk, and the Owner assumes no liability for indirect, consequential, punitive damages or loss of profits arising from the user's use of the Application.

Warranty Exclusion: The warranty referred to in the previous paragraph is not applicable if: (i) the application is not used in accordance with what is defined in this Legal Notice; (ii) any entity other than the Owner modifies the software or part of it or (iii) a malfunction occurs in the software caused by equipment or software product not supplied by the Owner.

Jurisdiction

This Legal Notice is governed entirely by Spanish legislation and any controversy that may arise between the parties in relation to the interpretation, compliance and/or resolution of this Contract, the Parties expressly submit to the Courts and Tribunals of the city of Barcelona, waiving any other jurisdiction that may apply to them.

Refund Policy for Routal customers

Except as required by law, payments are non-refundable, including fees and any other charges. The only reason why it is possible to request a refund is for a service outage and in that case it will only be applied to the time of service outage in an unscheduled manner and the refund can never be greater than the payment for the service.

Personal citizens of the European Union can request a refund of the entire amount within 14 days after the start of the subscription. This 14-day period begins when the subscription service starts.

In case of contracting an annual paid license, the refund can only be requested during the first 10 days from the date of the first subscription and a charge of 3 months of licensing will be generated as return management costs.

If the payment has been made by credit card, any refund may take between 5 to 10 days depending on the bank and/or credit institution.

Limitation of use

The user expressly agrees not to carry out the following actions: (i) use the Application in a way that could damage, disable, overload or deteriorate it, nor may he use it in a way that could interfere with the use and enjoyment of the Application by third parties; (ii) remove, hide or alter any copyright notice, trademark notice or other proprietary rights notice contained in the Application, (iii) send spam or duplicate or unwanted messages that violate applicable regulations; (iv) send or store unlawful, obscene, threatening, defamatory, unlawful or tortious material, including material that is harmful to children or infringes the privacy rights of third parties; (v) send or store material that contains software viruses, worms, Trojan horses or harmful computer code, files, scripts, agents or programs; (vi) interfere with or affect the integrity or performance of the Application, or the data it contains; or (vii) attempt to gain unauthorized access to the Application or related systems or networks.

The user is solely responsible for the content and information that he or she decides to publish through the Application, exempting SSC from any responsibility for this information and content owned by the user.

The user will be limited to the maximum expandable use of the tool and its features.

The data provided by the user is the property and responsibility of the user. The provider is not responsible for the content of any of the data provided by the user. All data generated by the tool, based on the data entered by the user, will be the property of the Owner.
